Popular Online Statement User Agreement (and/or other Communications)

 
 

This Popular Online Statement User Agreement (this “User Agreement”) is made a part of the Popular Online Banking Service (the “Service Agreement”) you have entered into with us and the term “Communications” as defined in the Service Agreement is amended to include this User Agreement and the periodic paper statements (the “Statements”) that we provide for your Accounts (the electronic version of a Statement is called an “Online Statement” in this User Agreement). This means that you agree to receive this User Agreement and the Statements, in addition to the other Communications accessed through the Services, electronically. Unless otherwise modified below, the Service Agreement will govern your receipt of Online Statements and all other Communications. Unless otherwise defined herein, capitalized terms have the meaning given to them in the Service Agreement.


CONSENT TO ELECTRONIC DELIVERY OF ACCOUNT STATEMENTS AND/OR OTHER COMMUNICATIONS

By entering into this User Agreement, you understand that we will cease providing you with periodic paper account Statements or other applicable Communications mailed to your mailing address of record, and that all future account Statements or applicable Communications will be accessed through the Services electronically. You may access through the Services to obtain, review, print and otherwise copy/download your Online Statement(s) or Communication(s). We will send a notice to you via email advising you of the availability of your Popular Bank Online Statement (or, as applicable, if a Communication is available for your review). You may then access your Online Statement or applicable Communication via the Services. You agree to notify us immediately, via the Service, telephone or email, of any change in your email address.


TIMING AND REVIEW

Your Online Statement will be dated the day of the email notifying you of its availability while applicable Communications may be up to 4 days later (the “Email Date”). You agree to promptly access/review your Online Statement or applicable Communication and any accompanying items and notify the Bank by calling or visiting by a branch within the applicable time period specified in your Personal Banking Disclosure and Agreement (“PBDA”) of any error or other irregularity. If you allow someone else to access/review your Online Statement or applicable Communication, you are still fully responsible to access/review such document for any errors or other irregularities. Any applicable time periods within which you must notify us of an error on your applicable Online Statement(s) or Communication(s) shall begin on the Email Date regardless of when you review and/or open the Online Statement(s) or Communication(s). Please review these timelines in the Service Agreement and the PBDA.


AVAILABILITY OF ONLINE DELIVERY METHOD

Personal deposit Accounts and some personal loan Accounts are available for Online Statements. The Service shows which of your Accounts are available to enroll in Online Statements and/or be delivered electronically.


PAPER STATEMENTS AND/OR OTHER PAPER COMMUNICATIONS

When you enroll an Account for Online Statements or e-delivery of other applicable Communications we will discontinue sending you paper Statements and/or paper Communications, as applicable, for the Account. You may, however, receive one or more paper Statements, or paper Communications as applicable, immediately after enrolling an Account. For joint Accounts, either owner (or a signer) may enroll in Online Statements, in which case paper Statements will no longer be sent to either owner. It is your responsibility to retain your paper Statements or Online Statements and review them for accuracy, even while your consent or withdrawal of your consent to receive Online Statements is being processed by us. When you agreed to the Popular Online Electronic Disclosure and Consent, you also agreed to have legal notices that are normally included with your Statement delivered electronically; they may arrive via email, web banner or any other electronic means we deem appropriate.


ONLINE STATEMENT AND OTHER COMMUNICATIONS ARCHIVES

After you enroll an Account for Online Statements or e-delivery of Communications, we will begin archiving your Online Statements and/or Communications for a maximum of 7 years. To access more than 7 years of Online Statements and/or Communications, you must either save your Online Statements and/or Communications to your computer, or print the Online Statements/Communications and save them in paper form. Whether you save electronic versions or print paper versions of your Online Statements/Communications, it is always your sole responsibility to keep your Online Statements (as well as your paper Statements), Communications, and the personal information contained in them safe and secure. While you are enrolled in Online Statements, you can also request that we send you a paper Statement by contacting your local banker or our Care Center at 1-800-377-0800. Please note that fees will apply and the bank representative will discuss them with you at the time of your paper Statement request.


E-MAIL ALERTS FOR ONLINE STATEMENTS AND OTHER COMMUNICATIONS

We will send an alert to the email address we have on file for you within the Service informing you that an Online Statement and other Communication are available for your review. It is your sole responsibility to log on to the Service to review your Online Statements and other Communications, and to maintain an up-to-date email address with us so that you receive Online Statement and other Communications email alerts in a timely manner. However, Online Statement and other Communications email alerts are a courtesy and we are not liable if, for any reason, we are unable to send you an email alert. If an e-mail alert that we send to you is returned to us as undeliverable, we have no obligation to notify you by any other means that your Online Statement and/or Communication is available through the Service. You understand that the email address we will use to notify you that an Online Statement and/or Communication is available is the address on file and available for your review or updating at any time within the Service. No other email address will be used.


ELECTRONIC CHECK IMAGES

By enrolling an Account to receive Online Statements, you will receive copies of paid checks drawn against the Account electronically. To review a paid check within an Online Statement you must click on the check number within the Online Statement. The check image will appear and can be printed for your records. While you are enrolled in Online Statements, you can also request that we send you a paper copy of a paid check by contacting your local banker or our Care Center at 1-800-377-0800. Please note that fees will apply and the bank representative will discuss them with you at the time of your paper check request.


WITHDRAWING CONSENT

You can withdraw your consent to receive Online Statements and/or other Communications at any time either online through the Service or by calling us at 1-800-377-0800. It may take up to two statement cycles or 60 days to begin receiving your paper Statements or Communication by mail again. It is always your sole responsibility to review your periodic statements or Communication in a timely manner regardless of the delivery method, even while your consent or the withdrawal of your consent to receive Online Statements or e-delivery of Communication is being processed.

You understand and agree that if another owner, authorized signer, or co-borrower on your Account also requested to receive Online Statements and/or Communications, you must both withdraw your consent to receive Online Statements and/or e-delivery of Communications in order for both of you to begin receiving paper Statements or paper Communications. An Account will remain enrolled to receive Online Statements and/or e-delivery of Communications as a result of the continuing enrollment by any owner, authorized signer, or co-borrower.

In addition, you understand and agree that you will no longer receive Online Statements and/or e-delivery of Communications if the Account, or a primary Account on a combined statement, is closed or its status changes (such as, for example, if a hold has been placed on the Account), even if the owners, authorized signers, or co-borrowers on the new Account are the same.


LIMITATION OF LIABILTY

YOU UNDERSTAND AND AGREE THAT YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY FAILURE OR NON-PERFORMANCE OF THE ONLINE STATEMENT OR OTHER COMMUNICATION SERVICE SHALL BE FOR US TO MAKE REASONABLE EFFORTS TO ENABLE YOU TO MAKE PROPER USE OF THE SERVICE.
